EB-3 Visa
Who Can Apply for the EB-3 Unskilled Visa
The category is open to workers from any country. What matters is the job, the employer and your admissibility.
- Different backgrounds.
- Same opportunity.
There is no nationality restriction on the EB-3 category, and no upper age limit. Applicants from any country can be sponsored, although how long you wait depends partly on where you were born, because visa numbers are allocated per country as well as per category.
What generally matters
A sponsoring employer
Without a US employer willing to go through PERM and file a petition, there is no EB-3 application.
Physical ability for the role
Many of these jobs involve standing, lifting or shift work. The requirements must be genuine to the role.
Basic communication
Formal English tests are not usually part of the category itself, but individual employers may require a working level.
Country of birth
Your country of birth, not your citizenship, normally determines which queue you wait in.
Family members
A spouse and unmarried children under 21 can usually be included as derivative applicants and receive residency at the same time as the principal applicant.
Because the wait in this category is long, children who are close to 21 need particular attention. There are legal provisions that can protect a child's age in some circumstances, and this is exactly the kind of point worth raising early rather than discovering late.
If you have children who may turn 21 during the process, raise it with us at the start. It changes how the timeline should be planned.
