- 1
Understand eligibility
Check the basic requirements for the EB-3 unskilled worker visa, including the job offer, experience level and other criteria.
Check eligibilityBefore anything is filed, it is worth being honest about whether the category fits. The unskilled subgroup is for permanent, full-time roles needing less than two years of training or experience.
This is also the point to surface anything that could complicate the case later — previous refusals, overstays, criminal matters, or a child approaching 21.
- 2
Employer sponsorship
A US employer offers a permanent, full-time job and agrees to sponsor the position through the process.
Job opportunitiesEverything downstream depends on a genuine vacancy with an employer prepared to commit. Through our US recruiting partner we work to match applicants with employers who sponsor these roles.
The employer must be able to pay the offered wage and to demonstrate that from the priority date onwards.
- 3
Labour certification (PERM)
The employer completes the PERM process to show there are no qualified, available US workers for the position.
Fees and who paysThe employer obtains a prevailing wage determination, advertises the role under set rules, and files the PERM application with the Department of Labor.
Cases can be selected for audit, which adds time. The costs of this stage are the employer's responsibility under US regulations.
- 4
Immigrant petition (Form I-140)
Once PERM is approved, the employer files Form I-140 with USCIS to petition for you as a permanent worker.
Required documentsThe petition establishes that the job and the employer qualify, and that you meet the role's requirements. Your priority date — your place in the queue — is normally set when the PERM application was filed.
We help you assemble the evidence the petition needs and keep every document in one place.
- 5
Wait for your priority date
After approval, you wait for your priority date to become current in the monthly Visa Bulletin.
Processing timesThis is usually the longest stage of an EB-3 unskilled case, because only about 10,000 visas are available worldwide in this subgroup each year.
The Visa Bulletin is published monthly and can move backwards as well as forwards. It is worth checking it yourself rather than relying on anyone's prediction.
- 6
Apply for your visa
When your priority date is current, you apply for the immigrant visa through consular processing, or adjust status if you are already in the US and eligible.
Most applicants outside the United States go through consular processing at a US embassy or consulate, submitting the immigrant visa application and supporting civil documents.
This is when the document set you have been building really matters — missing or inconsistent records are the most common cause of delay here.
- 7
Medical, interview and decision
Complete your medical examination with an authorised physician and attend your interview.
The medical examination must be done by a panel physician authorised for your location. Vaccination records are part of it.
At the interview you confirm your identity, your job offer and your history. Answer honestly and consistently with what is in your file.
- 8
Arrive and start your new life
Travel to the United States, begin the job you were sponsored for, and take the next step toward a brighter future.
You enter as a permanent resident. There are practical things to get right early — a social security number, tax registration, and keeping your residence in order if you travel.
Permanent residency can eventually open a route to citizenship once the residency requirements are met.
