EB-3 Visa
Fees and Who Pays Them
The categories of cost in an EB-3 case, which side is responsible, and what should make you suspicious.
- Know the costs.
- Know who pays.
Government fees change, so we do not publish figures here that would quickly be wrong. What matters more is understanding which costs exist and who is responsible for them.
Typical cost categories
| Cost | Normally paid by |
|---|---|
| Labour certification (PERM), including recruitment and related legal costs | The employer. US regulations require the employer to bear these costs. |
| Immigrant petition (Form I-140) filing fee | The employer, in most cases. |
| Immigrant visa application and related government fees | The applicant, generally. |
| Medical examination and vaccinations | The applicant. |
| Document collection, translation and courier costs | The applicant. |
| Travel to the interview and to the United States | The applicant. |
The PERM point is worth repeating: the costs of labour certification are the employer's responsibility under US rules, and should not be passed to you. If someone asks you to pay them, ask why in writing.
Signs something is wrong
Stop and get a second opinion if anyone:
- Guarantees a visa, a job, or a specific timeline
- Asks for a large cash payment with no receipt or written agreement
- Tells you to give false information, or to leave something off a form
- Refuses to put their fees in writing before you commit
- Asks you to pay the employer's labour certification costs
- Pressures you to decide immediately
